Terms of Use — Tryks

In short: Tryks organises links to videos on third-party platforms (Instagram, YouTube and TikTok). We do not host videos, we are not affiliated with those platforms and we depend on them for the content to remain accessible. The app has a free version and a paid version by subscription (Tryks Pro), which renews automatically until you cancel. By using the app you agree to these Terms.

1. Acceptance

By installing and using the Tryks application ("application", "app", "service"), you declare that you have read, understood and fully accepted these Terms of Use and the Privacy Policy. If you disagree with any point, do not use the app.

Tryks is developed by Daniel Cavalcante (independent developer, a natural person). Contact: info@tryks.app.

4. Licence of use

We grant you a personal, non-transferable, non-exclusive and revocable licence to use Tryks, in accordance with these Terms.

On Apple devices: the licence to use the application itself follows Apple's standard end-user licence agreement, accepted when you download the app from the App Store. These Terms supplement that agreement and deal with the service, the subscription and privacy; as regards specifically the licence of the application on Apple devices, Apple's agreement prevails. Support is ours, not Apple's — contact us at the address in section 12.

5. Free plan, taster days and Tryks Pro (subscription)

5.1 Free plan

Tryks can be used free of charge and with no time limit. We run no advertising of our own on any plan — but note: videos play through the source platforms' players, and YouTube may show ads before or during a video, on the free plan as well as on Pro. Those ads belong to the platform, not to us; we cannot remove them and we are not paid for them. Subscribing to Tryks Pro does not get rid of YouTube's ads — Pro unlocks features of the app, it does not change the video platform. And subscribing to YouTube Premium may not get rid of them here either: Tryks opens the video through the public player, without signing in to your account on YouTube (the app asks for no platform login at all), and Premium benefits depend on your being identified. The free plan has two limits, as of today: up to 2 activities and up to 50 videos stored in total (the same video saved in two activities counts twice). The counter inside the app shows how much you have used. These numbers may be adjusted in future versions; if they go down, the content you have already stored is not deleted.

Adding videos, watching, organising, searching, filtering, taking notes, tracking progress and exporting and importing backups are free, with no usage limit.

5.2 Daily taster of the advanced controls — this is not a subscription

The app offers a limited number of taster days for the advanced video controls (slow motion, frame by frame, markers and A→B segments). You choose when to activate each day; the activation lasts until midnight by your device's clock and uses up one of the taster days available.

The taster is not a free subscription trial. It creates no subscription, triggers no charge, converts into no paid plan and requires no cancellation. During the taster you remain on the free plan, with the same activity and video limits described in 5.1 — what changes is only temporary access to the advanced video controls. Once it ends, the app returns to its free behaviour, with no charge whatsoever.

5.3 Tryks Pro (subscription)

Tryks Pro is an auto-renewing subscription, offered in 12-month and 6-month plans, taken out through the official stores (Google Play and the App Store), at the prices they state for your country.

6. Privacy

Data processing is described in the Privacy Policy. In short: the app is local-first and collects no usage data. The exceptions are the data strictly necessary to process the Pro subscription (see Policy, section 5) and the reading of the device clipboard, done only to recognise a video link you may have copied and offer to add it (see Policy, section 4) — what is read is sent nowhere and can be turned off in the app's settings. Any new collection of data in future versions will be announced and will require your explicit opt-in.

7. No warranties

To the extent permitted by applicable law, Tryks is provided "as is", without warranties of any kind, express or implied — including, without limitation, warranties of fitness for a particular purpose or of uninterrupted operation.

Specifically: we do not warrant that third-party videos will always be available, that the external platforms (Instagram, YouTube, TikTok) will keep their APIs, their embed formats or their usage rules stable, nor that automatic routines (fetching thumbnails, titles, captions) will work for all content.

This matters and is not hypothetical: Tryks features that depend on those platforms may stop working at any moment, temporarily or permanently, by their decision and without notice to us — for example, if a platform changes the way a video is shown outside its own app, restricts embedded playback or discontinues that feature. This may affect an entire platform, not just one video. As we have no control over those decisions, they do not constitute a defect of the application; we will do what we can to adapt the app when they happen. What remains yours, in any scenario, is what is on your device: your links, titles, notes, tags, markers, segments and progress, which you can export at any time.

8. Limitation of liability

To the extent permitted by applicable law, the developer is not liable for: loss of data resulting from device malfunction, accidental deletion or absence of a backup; unavailability of third-party content; or any indirect losses arising from the use of, or the inability to use, the application.

Take a regular backup of your library (Settings → Backup → Export) — it is your main protection against data loss.

Consumer rights: nothing in these Terms limits consumer rights provided for by applicable law (in Brazil, in particular the Consumer Protection Code).

9. Termination

You may stop using the application at any time by uninstalling it. Uninstalling does not cancel the subscription: cancellation is done in your store account (see section 5.3). Before uninstalling, export your backup — the data is only on the device and goes with it.

We may discontinue the application or specific features at any time, with reasonable prior notice where possible. If Tryks Pro is discontinued, no new charge will be made and access remains until the end of the period already paid for.

10. Changes to these Terms

We may update these Terms. The most recent version is always on this page, with the update date at the top. Material changes — such as a change to the billing model, to the free plan's limits or to your rights — will be announced inside the app or in the new version's description in the store at least 30 days in advance, and apply only going forward. If you disagree with a change, you may cancel the subscription before it takes effect and carry on using the free plan, or stop using the app — in both cases your data stays on the device and can be exported.

11. Governing law, jurisdiction and language

These Terms are governed by the laws of the Federative Republic of Brazil, where the developer resides and from where the application is published.

If you live outside Brazil, this does not reduce your rights. The choice of Brazilian law does not deprive you of the mandatory protections granted to you by the consumer protection law of the country where you habitually reside. Where that law so determines, it prevails over this clause, and no provision of these Terms is to be read as a waiver of a right that your local law makes non-waivable. This applies whatever the language in which you read these Terms and whatever the store through which you installed the app or subscribed to Tryks Pro.

Jurisdiction: the courts of the consumer's domicile are chosen. You may bring proceedings before the courts of the place where you live — nothing in these Terms obliges you to litigate in Brazil.

Language: these Terms are published in several languages so that you can read them in your own. The Portuguese version is the original, and the others are translations of the same content — none of them grants less than another. If a translation gives rise to a doubt of interpretation, the reading more favourable to you prevails; and where your country's law determines that the local-language version prevails, that is the one that prevails.
