Terms of Use — Tryks

1. Acceptance

By installing and using the Tryks application ("application", "app", "service"), you declare that you have read, understood and fully accepted these Terms of Use and the Privacy Policy. If you don't agree with any point, don't use the app.

2. Who we are

Tryks is developed by Daniel Cavalcante (independent developer, individual). Contact: info@tryks.app.

3. What the app does (and does NOT do)

• Tryks stores links and metadata (title, description, thumbnail, author) of public videos from Instagram (reels, posts) and YouTube (regular videos, Shorts).
• Videos are played by the official players of those platforms (public embed), inside the application itself. Tryks does not download, store or redistribute videos.
• Tryks is not affiliated, sponsored, endorsed or connected with Instagram (Meta Platforms, Inc.) or YouTube (Google LLC).
• Content access depends entirely on those platforms' policies, availability and restrictions. If a video is removed, set to private, has copyrighted-audio restrictions or blocks embedded playback, it may stop working in Tryks without notice.

4. License to use

We grant you a personal, non-transferable, non-exclusive and revocable license to use Tryks, in compliance with these Terms.

You agree not to:

• use the app for illegal purposes or to violate third-party rights;
• copy, modify, decompile, reverse engineer or redistribute the application;
• use the application to circumvent restrictions, protection systems or terms of third-party platforms (Instagram, YouTube);
• use the application to download, redistribute, publicly display or commercialize third-party videos — the app only facilitates personal consumption of public content.

5. Free plan and Tryks Pro (in-app purchase)

Tryks can be used for free, with limits set inside the app (including, but not limited to: maximum number of sports created, maximum number of videos kept, and an initial limited sample of slow motion). These limits may be adjusted in future versions.

Tryks Pro is sold as a one-time non-consumable purchase (not a subscription) through the official stores (Google Play and App Store), at the prices listed there.

• Pro unlocks features of the current version of the application (for example: unlimited sports and videos, always-available slow motion, exporting curated lists). New features, created in future versions, may be offered as separate add-ons or distinct plans — what you bought today remains unlocked.
• The purchase is processed by the store (Google Play or Apple) and validated by our partner RevenueCat (see the Privacy Policy, section 5).
• You can restore your purchase at any time on the same store account where you bought it. Because Tryks has no login of its own, the purchase does NOT migrate across platforms (a Google Play purchase does not work on the App Store, and vice versa).
• Refunds: refund policies are defined by the store where the purchase was made (Google Play or Apple). Request refunds directly with the store. If your Pro access is revoked due to a refund, your data (videos, tags, progress) is not deleted — you simply return to free-plan limits, without losing already-saved content.
• Price or feature changes: we may change prices and the set of Pro features at any time, but changes only apply going forward — anyone who already purchased keeps access to what was promised at the time of purchase.

6. Privacy

Data handling is described in the Privacy Policy. In short: the app is local-first and does not collect usage data. The only exception is data strictly necessary to process a possible Pro purchase (see Privacy Policy, section 5). Any new data collection in future versions will be communicated and will require your explicit opt-in.

7. No warranties

To the extent permitted by applicable law, Tryks is provided "as is", without warranties of any kind, express or implied — including, without limitation, warranties of fitness for a particular purpose or of uninterrupted operation.

Specifically: we do not guarantee that third-party videos will always be available, that external platforms (Instagram, YouTube) will keep their APIs and embed formats stable, nor that automatic routines (fetching thumbnails, titles, captions) will work for all content. Features that depend on those platforms may stop working at any time.

8. Limitation of liability

To the extent permitted by applicable law, the developer is not liable for: data loss resulting from device malfunction, accidental deletion, or lack of backup; unavailability of third-party content; or any indirect damages arising from the use or inability to use the application.

Make periodic backups of your library (Settings → Data → Export) — it is your main protection against data loss.

Consumer rights: nothing in these Terms limits consumer rights granted by applicable legislation (in Brazil, especially the Consumer Defense Code).

9. Termination

You may end your use of the application at any time by uninstalling it. We may discontinue the application or specific features at any time, with reasonable prior notice when possible.

10. Changes to these Terms

We may update these Terms. The most recent version is always on this page, with the update date at the top. Relevant changes will be communicated within the app or in the new version's description on the store.

11. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The venue of the consumer's domicile is elected, as applicable.
